Detailed Narrative Description of the Project:

Digitalization has offered the Asia and Pacific region opportunities for expanding digital intermediation platforms and digital trade. It has also underscored important challenges for domestic and international taxation regimes. The new agreement on international tax rules, including new nexus and profit allocation rules for taxing rights beyond physical presence, will be important for the region to continue taking full advantage of the digital transformation. Understanding their impact and ensuring consistency of digital tax rules with trade and investment regimes, domestic regulations and standards will be essential.

To examine and draw policy recommendations on the development and implications of cross-border digital tax rules in Asia Pacific, the interaction between international tax and investment regimes regarding digital products, and the role of cross-border data regulations on digital taxation.


Detailed Description of Actual Services Provided by SAMES:

1. Examine the interaction between international tax and investment regimes and implications of the adoption of international tax rules for the digital economy.

2. Assess the linkages between existing frameworks for cross-border data flows and taxation of digital products in Asia

3. Analyze the role of global rules in the Multilateral Instrument for Bilateral Tax Treaties and implications for digital taxation in Asia-Pacific economies.

4. Analyze the role of regional trade and investment and cooperation initiatives, such as Regional Comprehensive Economic Partnership (RCEP), Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP), Digital Economy Partnership Agreement, etc., for implementing digital tax rules and improving coordination of tax administrations.

5. Provide practical examples of best practices in tax provisions in relation to relevant areas of digital policy, including data flows, cybersecurity, data protection and data privacy.

6. Participate in workshop/discussion sessions for the presentation of preliminary results as well as the dissemination of the final study as needed.
